Terms of Use

These Terms govern your use of Mishava's public website, accounts, workspaces, shopping and referral flows, organization-facing features, and related services.

If you use Mishava on behalf of an organization, you confirm that you have authority to act for that organization and to bind it to these Terms where applicable.

Acceptance of Terms

By accessing or using Mishava, you agree to these Terms and the Mishava Privacy Policy. If you do not agree, do not use the service.

Who May Use Mishava

You may use Mishava only if you can form a binding agreement and, where you act for an organization, you have authority to do so. Some Mishava experiences are public, some are role-restricted, and some may be available only by invitation or approval.

Accounts and Access

  • Provide accurate registration and profile information.
  • Keep your credentials confidential and use reasonable security practices.
  • Promptly notify Mishava if you suspect unauthorized access to your account.
  • You are responsible for activity that occurs through your credentials unless caused by Mishava's own breach of these Terms.

Permitted Use

You may use Mishava for lawful evaluation, discovery, reporting, evidence handling, organization management, and related business or consumer decision-support purposes that the product is designed to support.

Prohibited Use

  • Using Mishava for unlawful, fraudulent, abusive, or deceptive conduct.
  • Interfering with the service, security controls, rate limits, or access restrictions.
  • Attempting to access data, accounts, or workspaces without authorization.
  • Uploading malicious code, malware, or content you do not have the right to submit.
  • Using automated access or scraping in violation of Mishava's technical or contractual restrictions.

Organization and Workspace Responsibility

If you use Mishava for an organization, that organization is responsible for its workspace configuration, member permissions, submitted content, and the instructions it gives Mishava through the service. Mishava may rely on workspace administrators and designated members to manage access and operational settings.

User Content

You retain ownership of content you submit to Mishava, subject to the rights needed for Mishava to host, process, secure, display, and share that content as directed by the applicable service flow or workspace configuration. You are responsible for ensuring you have the rights needed to upload and use that content.

Intellectual Property

Mishava and its licensors retain all rights in the Mishava software, site design, branding, documentation, and other platform materials, except for your own content and any third-party materials used under their own terms.

Feedback

If you send Mishava feedback, suggestions, or product ideas, you grant Mishava a non-exclusive, worldwide, royalty-free license to use that feedback without further obligation to you, unless separate written terms say otherwise.

Third-Party Services and Links

Mishava may link to third-party sites, organizations, documents, seller listings, or dealer destinations. Mishava is not responsible for third-party content, products, policies, or transactions that occur outside Mishava. In shopping flows, Mishava may help you discover or compare options, but final purchase steps can occur on the seller or dealer site.

Availability and Changes to Service

Mishava may add, change, pause, or remove features at any time. We do not guarantee that every feature, route, or experience will always be available, error-free, or offered in the same form.

Beta / Invite-Only / Pre-Launch Language

Some Mishava experiences may be limited, pre-launch, pilot, beta, or access-controlled. Mishava currently operates some or all access flows on an invite-only or approval basis.

Fees and Billing

Unless Mishava expressly offers paid features under a separate order, subscription, or checkout flow, these Terms do not themselves create a payment obligation. If Mishava later provides paid services, additional pricing or billing terms may apply to those services.

Disclaimers

Mishava is provided on an "as is" and "as available" basis to the fullest extent permitted by law. Mishava does not guarantee uninterrupted availability, complete coverage, or that every result, listing, or data point will be available for every use case or market.

Limitation of Liability

To the fullest extent permitted by law, Mishava and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill arising out of or related to your use of the service. Mishava's aggregate liability for claims arising out of these Terms will not exceed the greater of the amount you paid to Mishava for the relevant service in the 12 months before the claim arose or one hundred U.S. dollars (US $100).

Indemnity

You will defend, indemnify, and hold Mishava harmless from claims, losses, liabilities, and expenses arising from your content, your misuse of the service, or your violation of these Terms or applicable law.

Termination / Suspension

Mishava may suspend or terminate access if needed to protect the service, comply with law, respond to security issues, or enforce these Terms. You may stop using Mishava at any time. Provisions that by their nature should survive termination will survive.

Governing Law / Venue

These Terms are governed by the laws of California, USA, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the service will be brought exclusively in the state or federal courts located in California, subject to applicable law.

Changes to Terms

Mishava may update these Terms by posting the revised version on this page and updating the "Last updated" date. If a change is material, Mishava may provide additional notice through the service or another appropriate channel.
